ATLANTA (AP) ? A judge has scheduled an emergency custody hearing requested by Usher's ex-wife a day after one of the pair's sons nearly drowned in a pool at the singer's Atlanta home.
A lawyer for Tameka Foster Raymond filed the request in Fulton County Superior Court on Tuesday and Judge John J. Goger approved it the same day, scheduling a hearing for Friday. The court filing says the boy "suffered a near-death accident" while left unsupervised in a pool at the Grammy winner's home.
A lawyer who has previously represented Usher in the custody dispute did not immediately respond to an email seeking comment, and her office said she was scheduled to be in court all week.
Atlanta police have said 5-year-old Usher Raymond V fell to the bottom of the pool and became stuck in the drain on Monday. A housekeeper tried unsuccessfully to free him. A contractor doing work at the home pulled the boy from the pool and performed CPR.
The boy was "conscious, alert and breathing" when emergency medical workers arrived, police said. The boy was in the intensive-care unit of a hospital being treated for his injuries, Tameka Raymond's court filing says.
Usher Raymond V is one of two sons of Usher and Tameka Raymond, who divorced two years after getting married in 2007. The singer went through a long legal fight with his ex-wife and was awarded primary custody of his two sons last year.
Usher has failed to discuss issues affecting the children with Tameka Raymond and leaves the children with caregivers when he travels around the world for work rather than parenting them himself, Tameka Raymond said in a sworn statement attached to the court filing. It isn't in the best interests of the children to be left in the care of third-party caregivers, and Tameka Raymond is capable of caring for the children, the statement says. The children have said they'd rather be with her than with caregivers, the statement says.
The near drowning of the singer's son comes nearly a year after Tameka Raymond's 11-year-old son, Kile Glover, died after being critically injured in a boating accident. The boy, who was the stepson of Usher, was run over by a personal watercraft on Lake Lanier northeast of Atlanta.

Provo ? Long before he played in six games, started in two last year for BYU and learned what it felt like to be under the microscope as the Cougars? quarterback of the future, Taysom Hill got a taste of what it means to be targeted on the football field.
While a senior at Highland High School in Idaho, Hill was kicking off against crosstown rival Pocatello when an opposing player ran directly at him while his head was still down and applied a vicious hit that easily could have hospitalized the state?s 5A All-Idaho Player of the Year. Hill recovered quickly and was able to quarterback his team to the win, while the player?s coach was subsequently suspended for ordering the opening-kickoff cheap shot, and the play soon went viral on YouTube.

"In football, you can get hurt on any play, even the kickoff," Hill said nearly five years later.
And even on the last play of the game, as he learned last year against Utah State, suffering a major knee injury after a needless running play in the closing seconds of a 6-3 win that caused him to miss the rest of the season and signaled the beginning of the end for then-offensive coordinator Brandon Doman.
Hill is back, perhaps more quickly than most people suspected he would be, and ready to be the unquestioned leader of Robert Anae?s "go hard, go fast" offense as BYU opens preseason camp on Saturday in Provo. The sophomore said in late June that his surgically repaired knee felt fine and that he could have played that week. He said his morning workout that day "was probably the hardest and fastest that I have ran since last October, and it felt really good. I felt fast and quick."
Now, four weeks away from the 2013 season opener at Virginia (1:30 p.m. MT, ESPNU), the task for BYU coaches will be to keep Hill healthy, all while they continue to install the uptempo offense introduced at spring camp. Anae said in June that so much time and energy has been invested in Hill since he was named the starter at the conclusion of spring camp that extraordinary steps have been taken to teach Hill how to protect himself.
"It has been emphasized daily," Hill said. "I had a conversation with coach Anae the other day. I don?t know if he was joking. I mean, I hope he was joking. He said, ?If you don?t slide in a game, I am going to pull you out.? Coach Anae and coach [Bronco] Mendenhall have all made that very clear, that the expectation is that I need to protect myself."
That won?t be easy, because Hill is a good ball-carrier ? he rushed 55 times for 336 yards and four touchdowns last year before the injury ? and is still considered one of the fastest players on the team. He loves to show off his running ability, but Anae said called quarterback runs, like the one that got Hill hurt ? will be few and far between.
"Because I do believe we have running backs that are much better at called runs than the quarterbacks," Anae said. "So, why not let the running backs do the called runs? If things break down, I do believe he?s got the ability to make things happen and create on the field, athletically. It is our job as coaches to teach him how to protect himself, because he does have the skills to protect himself. He absolutely has."
Mendenhall said last winter that the starting quarterback competition would be wide open, but early on in spring camp it became apparent that Hill was not only close to being 100 percent, but he also was the clearly the frontrunner to get the job. And when his primary competition for the spot, SUU transfer Ammon Olsen, went down with a minor knee injury in the spring game, there was no question that Hill was the man.

"There is evidence, to me, and coach Mendenhall, and our offensive staff, and I believe, to the team, that Taysom has qualities that would make a starting quarterback at any program, in any offense," Anae said, when asked why Hill earned the starting nod. "He?s fast, he?s physical. That arm can throw far, can throw short. He works well with teammates. He?s accurate.
"Man, when you get a situation like that, then that?s your quarterback. That?s the position that is the most challenging on the field. I am very confident that he has all the qualities that we need in a quarterback."
Also confident is Hill?s golfing partner and good friend, slot receiver JD Falslev.
"I have seen a lot of great competitors over the years, but I have never seen one like Taysom that competes day in and day out, every single time," Falsev said. "There are no gray areas, or anything like that, with Taysom. It is who he is. He is a born leader, and it shows by the way he works, on and off the field."
Hill?s athleticism and leadership abilities are evident. What isn?t clear to some is whether he can throw the ball accurately enough and avoid mistakes enough to help BYU beat some of the better teams on its 2013 schedule, such as Texas, Utah, Boise State, Notre Dame and Wisconsin. He completed 42 of 71 passes last year for 425 yards and four touchdowns.
"He can throw it well," said BYU quarterbacks coach Jason Beck. "He is not limited in the pass game at all. It is just that he also has that ability to run, and that might overshadow his arm a bit. He throws it accurately, and with touch downfield, especially on the deep balls. It is just a matter, with any young quarterback, of getting more consistent, getting more accurate and getting more quick with his decisions."
And staying healthy ? which BYU knows must happen for all those other things to occur, too.

HELENA, Mont. (AP) -- Strong thunderstorms that moved across Montana left a trail of damage to crops and buildings along with downed trees and power outages.
The worst damage from Thursday's storm may have occurred in Gallatin County, where winds gusting up to 89 mph devastated wheat and barley crops that likely would have been harvested next week, Montana Grain Growers Vice President Matt Flikkema said.
"I've never seen crop damage to the extent we have here in the valley," Flikkema said Friday. "There are very little crops that will be harvested out of the area."
Flikkema said the damage could approach $50 million, even without taking into consideration what happened to 5,000 acres of potatoes.
Most of the grain crops are used for seed, meaning there could be a shortage of seed to plant next year, he said.
The storm started in southwestern Montana, where wind gusts up to 104 mph were recorded in Polaris, northwest of Dillon, causing major damage to homes and some trees, the National Weather Service reported.
Betty Barnes of Polaris said she lost several trees, including a big one that fell near her driveway.
"I said to myself, `Well, thanks, God, for the firewood and for protecting my house,'" Barnes told The Montana Standard.
Strong winds and possibly a tornado caused severe damage in Twin Bridges, uprooting trees and blowing the roof off at least one building.
A weather service representative was expected to visit Twin Bridges on Friday to determine if a tornado had touched down, said Steve DiGiovanna of Madison County Disaster and Emergency Services.
Some falling trees damaged historic buildings, including the museum, and the roof was ripped off a veterinary clinic outside of Twin Bridges. An airport hangar was destroyed, a travel trailer was crushed by falling trees, and a grandstand at the Madison County Fairgrounds was flipped over and destroyed, he said.
Twin Bridges Mayor Tom Hyndman said the wind also uprooted a large spruce tree that is decorated every year for the town's Christmas Stroll.
Golf-ball sized hail fell across much of Belgrade and the northern part of Bozeman, the weather service reported.
NWS meteorologist Todd Chambers of Billings said the storm began in the southwestern part of the state Thursday afternoon and moved east, causing damage as far away as Billings.
The "long-lived, long-path" storm was unusual for this time of year, he said.
In eastern Montana, a funnel cloud was reported near Acton, northwest of Billings, where at least four mobile homes were destroyed and at least three more were damaged by apparent straight-line winds gusting up to 90 mph.
The Billings Gazette reports the wind picked up two of the trailers in a trailer park, with one of them being tossed into a neighboring trailer.
Duane Cowdin lost his garage to the storm, which he said scattered debris "from hell to breakfast."
Cowdin said a neighbor's horse was spooked by the storm, got tangled in barbed wire and had to be put down because its leg was so badly damaged.
There was another unconfirmed report of a tornado in Broadview, Chambers said.
Golf-ball-sized hail was reported in parts of Billings, as well. A tree on the West End caught fire after being struck by lightning.
The storm knocked out power along its path and crews were still working Friday morning to restore service.
A second set of storms moved through the Helena. Over an inch of rain fell in a swath, moving northeast from an area near the city through eastern Chouteau County, the weather service said.
